What is a walking possession order?
This is an agreement that means any goods to be seized by a Bailiff legally belong to him and can be taken at any time.
However if a payment plan has been agreed and you maintain the monthly payments, it's possible the Bailiff will allow the goods to stay in your home.
How do I know if the walking possession order is valid?
- A Bailiff must have gained peaceful entry into your property.
- Once inside he will make an inventory of claimed goods (if valuable). The Bailiff cannot do this by simply looking through a window - if this happens, you have the right not to sign the possession order.
- Once the goods are seized the Bailiff will usually leave and return with a walking possession order.
- He should only take items from the person who owes money - it's up to the debtor to prove the goods are or are not theirs.
It's worth noting goods seized normally sell at auction for about 10% of their original value. Because of this the Bailiff may look for items that sell for a higher value than you actually owe.
