What is a Statute Barred debt?
If your creditor has not contacted you for a period of 6 years or more and no action has been taken on the debt, a debt is blocked – or considered Statute Barred.
Although the debt is still legally owed, the creditor is not able to take legal action against you to recover the debt.
It is also considered unfair if a debt collector misleads you into believing the debt is legally recoverable, or if they press for payment after you’ve said you won’t be paying the money owed.
If this happens it could amount to debt harassment under Section 40(1) of the Administration of Justice Act 1970.
