What is an N9A form?

N9a Form:

N9A (PDF, 365k)

The N9A form is provides the court and creditors with information about your financial circumstances. It allows the client to admit liability for the debt and offer an affordable monthly payment.

The court will use this statement - along with any other information from you or your creditor - to decide on a rate of pay.

How do I complete an N9A form?

Follow our advice in the following sections:

Personal details

This section includes your name, address and date of birth. If there are joint defendants but separate N9A forms, it must be indicated whether the offer is joint or separate.

Dependants

This is used to calculate the level of expenses. Partners must be included even if they are independent - if they do not wish to do so, an additional letter should be provided. They must still be put on the form as figures are worked out on a household basis.

Employment

All employment must be included for the client - if there isn’t enough room, extra paper can be used. Take home pay should be added in the income section.

Bank accounts and savings

All savings must be declared. If you have a joint account, only your half will be taken into consideration.

Court officers will look at what funds are available to pay the debt and whether your income matches your financial statement.

Property

This part provides the creditor with information regarding property, where a charge could be enforced in the event of default on the judgment.

Income

You must include all household income as well as any benefits (even for children) unless you’re completing a single income and expenditure - just for you. Explain this fully on separate paper if necessary.

Expenses

State your expenses here unless you are using joint income figures only. Explain carefully what each expense is - especially what 'other' may consist of.

Priority debts

List any priority debts where offers have been made regarding arrears - and whether they have been accepted. You should also include business debts for example VAT or income tax.

If you’re unsure about how much spending will go towards arrears, total the payments including arrears and enter it on section 7 - 'expenses'. Make notes in box 8 to explain.

Court orders

You should only include existing court orders here - not the one you’re dealing with right now. If there’s not enough room on the form, use extra paper or separate financial statements.

Credit debts

This section is for normal creditors you are paying which do not have a court order against you. Only include amounts being paid and a financial statement to indicate the level of debt, including any offers made.

Offer of payment

If there is an amount left over from your disposable income, an offer should be made - however minimal.

When the form is completed photocopy it. Keep one and send the other via recorded delivery.
