If you've been ordered by the court to pay an amount that isn't affordable, an N245 allows you to 'vary' the order.

After submitting the form you may find your payments have been reduced. To achieve this you might be asked to supply evidence as to why your situation has changed or why the payment is not affordable.

You can also complete an N245 form if you have a CCJ or a warrant of execution that you'd like to suspend. The court will send a copy of the N245 to the creditor – if they do not respond in 14 days the variation must be granted. However if the creditor objects, the court officer will make a decision based on the 'determination of means' guidelines.

Once the variation order is set, the creditor or client has 14 days to apply for reconsideration if they do not agree. The case will then usually be passed to a local court where a judge will make a final decision.
